Terms of Use

The Nelson-Atkins Museum of Art makes this digital publication freely accessible in support of its educational mission to encourage broader access and greater understanding of the works in its collections. Use of any material included constitutes an acceptance, without limitation or qualification, of the following terms of use.

  1. All content protected under copyright. The Nelson-Atkins retains all rights it may hold, including copyright, in data, images, software, documentation, text, video, audio, and other information. The museum does not warrant that use of the material will not infringe on the rights of third parties. It is the responsibility of the user to determine and satisfy copyright or other use restrictions prior to copying, transmitting, or making other use of protected works beyond that allowed by “fair use” as such term is understood under the United States Copyright Act.

  2. Fair use permitted. Content is made available for limited non-commercial, educational, and personal use only, or for fair use as defined in United States copyright law. Users may download these files for personal use, subject to any additional terms or restrictions applicable to the specific material, and users must properly cite to the source of the material. By downloading, printing, or using the material, whether accessed directly or indirectly, users agree that such uses will comply with fair use, and will not violate the Nelson-Atkins’ or any other party’s proprietary rights.

  3. Copying or redistribution in any manner for commercial use, including commercial publication, or for personal gain is strictly prohibited. To license images in the Nelson-Atkins’ collection, users should contact https://nelson-atkins.org/contact/#publication-image-request

    • Beyond the boundaries of fair use, the artist (if living), the artist’s estate or foundation, or a rights organization may administer copyright permission. For further resources and information, the major U.S. rights organization is Artists Rights Society (including VAGA represented artists; see http://www.arsny.com/complete-list-of-member-artists/ for a list of artists represented); DACS (https://www.dacs.org.uk/) may be consulted in the U.K.
